Submerged Lands Authorizations
Activities that occur on state-owned submerged lands also require an
applicable sovereignty submerged lands authorization--typically in the
form of a consent by rule, a letter of consent, a lease, or an easement.
This authorization is linked to the processing of the environmental
resource or wetland resource permit application, such that all the
materials required for both the applicable permit and the sovereignty
submerged lands authorization must be received before either application
becomes complete, and a decision must be reached that the proposed
proposed activity qualifies for issuance of both the sovereignty
submerged lands authorization and the regulatory authorization before
either authorization can be granted.
