Revised and Readopted Lists of Impaired Waters for
the Cycle 2 Group 1 Basins

As part of the agency action adopting the lists of impaired waters
for the Group 3 Basins, the
Department also revised the verified lists of impaired waters and delist
lists by Secretarial order for the following Group 1 basins: Lake Okeechobee, Everglades
West Coast, St. Marks-Ochlockonee River, Tampa Bay, Ocklawaha, and
Suwannee, which were originally adopted on June 3, 2008 and amended on
May 19, 2009. The Group 1 lists were revised to make necessary changes
in response to EPA’s review.

The Department announces the availability of revised and readopted
lists of impaired waters for the Group 1 Basins for Cycle 2: Everglades
West Coast, Lake Okeechobee, Ocklawaha, St Marks/Ochlockonee, Suwannee,
and Tampa Bay. These lists for the Group 1 Basins were adopted by a
Secretarial Order signed on May 19, 2009. Exhibit 1 of the order
consists of the verified and delist lists with the Office of General
Counsel case numbers for the listings. These can be found in the lists
provided below. Requests for an administrative hearing must be received
no later than June 19, 2009.
Revisions to these lists were necessary in order to receive approval
by EPA. DEP applied the revised IWR methodology for the Group 1 lists
submitted to EPA for approval on October 17, 2008, that contained both
Groups 5 and 1. This was the first application of the revised IWR and
EPA conducted a very thorough review in order to document and support
any legal challenges to lists or the IWR approval. In their review of
the Group 5 and 1 lists, EPA identified a number of issues that resulted
in necessary changes to the verified and “delist” lists. This generally
reflects implementing procedures and policies for the first time, by
both agencies. TMDL development and adoption has already occurred for
scheduled waterbodies in these basins. The final step in the restoration
of these waterbodies will be the development, by watershed stakeholders
and DEP, of a Basin Management Action Plan (BMAP). The BMAP will specify
the activities, schedule, and funding sources that point and nonpoint
source dischargers will undertake to restore the water body.
