Domestic Wastewater Residuals Rulemaking Updates
The Department recently completed rulemaking to revise Florida’s
domestic wastewater residuals regulations, Chapter 62-640, Florida
Administrative Code. This webpage provides information on the
Department’s rulemaking efforts.
Domestic wastewater residuals, also known as biosolids or sewage
sludge, are an organic material derived from the treatment of municipal
sewage in a wastewater treatment facility. When properly treated,
residuals can be beneficially recycled as a fertilizer or soil amendment
because they contain vital plant nutrients and organic matter. The
treatment and beneficial use of residuals are regulated by the U.S.
Environmental Protection Agency, the Florida Department of Environmental
Protection and, in some instances, by local government.
Announcements/Upcoming Events
Final Rule - The revised Chapter 62-640, F.A.C., will be
effective on August 29, 2010. The final rule currently can be viewed
at the Department of State’s Florida Administrative Code website at:

Second Notice of Change - A minor Notice of Change was
published on Friday, July 16, 2010, to change the word “may” to
“shall” in four places in Rule 62-640.700, F.A.C. These minor
changes were based on comments from the Joint Administrative
Procedures Committee. The Notice of Change can be viewed at:

–The Notice of Change providing the changes to the proposed rule as
adopted by the ERC was published in June 11, 2010 edition of the

ERC Adoption – The ERC adopted revisions to
Chapter 62-640, F.A.C., on May 20, 2010. A number of amendments were
made to the proposed rule at the adoption hearing and the resulting
changes can be found in the
Notice of Change (see above). The rule is expected to become
effective later this summer.
Continuation of the ERC Adoption Hearing – May 20, 2010
At the December 1, 2009 meeting of
Environmental Regulation Commission (ERC) held in Tallahassee, the
ERC passed a motion to continue the adoption hearing for revisions
to Chapter 62-640, F.A.C., at a future meeting of the ERC. The
continuation of the adoption hearing is scheduled for the
May 20, 2010
public meeting of the Environmental Regulation Commission (ERC). The
meeting will be held at 9:00 a.m. in Conference Room A of the
Douglas Building, 3900 Commonwealth Blvd, Tallahassee, Florida.
