Topic: AST Rulemaking Workshop. While during the Workshop all proposed changes to Chapter 62-762, F.A.C., will be discussed. The focus of the discussion will be the changes made pursuant to comments provided during and after the Technical Advisory Group meetings.

Changes to Proposed Revision of Chapter 62-761, F.A.C. to conform with EPA regulation 40 CFR 280

On July 15, 2015, USEPA published the Final Rule for 40 CFR 280 Revising Underground Storage Tank Regulations. The Final Rule establishes certain requirements that differ from the Department’s previous draft proposed rule. The Department has begun revising proposed 62-761, F.A.C., to reflect the changes to the federal regulation. The areas of Notification, Equipment Compatibility with Product Stored, Integrity Testing and Monitoring of Corrosion Control are few of the areas that will be addressed. The Department has developed a matrix describing the proposed changes and a revised draft.


Change to Operator Training Requirements under Chapter 62-761, F.A.C.
(Posted 08/05/2015)

The Operator Training deadline stipulated in Chapter 62-761.350 Florida Administrative Code (F.A.C.), requiring Owners and Operators to demonstrate compliance with Operator Training by August 6, 2015 will not be enforced due to the USEPA’s Final Rule, 40 CFR 280 Subpart J, which establishes a compliance date of October 13, 2018. Facilities not meeting the operator training requirement by August 6, 2015 will not constitute or be cited as a violation. The department has begun rule revision to reflect the changes to the federal regulation.

Facility owners are strongly recommended to continue to designate, train and maintain records of trained personnel. For further information please see the Operator Training Information page.
