DOCKS IN AQUATIC PRESERVES
Regulatory criteria
____ Less than 500 square feet of dock structure (access walkway and
terminal platform) over water or wetlands, the dock does not impede
navigation or the flow of water, and the dock is the sole dock constructed
pursuant to an exemption as measured along the shoreline for a minimum
distance of 65' = Exempt (no fee)
____ Greater than 500 square feet over water or wetlands and less than
2000 square feet = Noticed General Permit ($100 processing fee and
meet the criteria in the attached 62-341.427)
____ Greater than 2000 square feet or does not meet the Noticed General
Permit criteria = Standard General Permit (required additional
application fee, allow 90-120 days for permit processing, agent or
consultant must submit drawings sealed by a registered professional
engineer)

Proprietary (State Lands) criteria
____ Applicant's property borders the mean high waterline (MHW) of the
affected waterbody (a warranty deed or proof of upland ownership should be
submitted) and all activities are within the applicant's riparian rights
area (the area between the extension of the property lines into the
waterbody).
____ All structures or other activities (i.e. mooring areas, boat
lifts, etc.) are set back a minimum of 25' from the applicant's riparian
rights lines (unless the shoreline frontage is less than 65'). For
shorelines that are greater than 65 linear feet, a sworn affidavit (set
back waiver) is necessary from the adjacent upland riparian owner if the
structure or other activities do not meet the 25' set back.
____ The dock does not extend waterward of the MHW or ordinary high
water (OHW) line more than 500 feet or 20 percent of the width of the
waterbody (as measured from MHW to MHW) at the particular project
location, whichever is less. In addition, docks, mooring pilings, or other
such structures do not extend within 100' of a federal navigation project
channel.
____ The dock does not extend out from the shoreline further than to a
maximum depth of -4' mean low water (MLW). When the water depth is -4' MLW
at an existing bulkhead, the maximum dock length from the bulkhead shall
be 25'.
____ The access walkway of the dock is elevated a minimum of 5' above
the MHW if it is over seagrasses, corals, mangroves, salt-water marshes,
or oyster bars.
____ Any wood planking used for the dock is no more than eight inches
wide and spaced no less than one-half inch apart after shrinkage if the
dock is over seagrasses, corals, mangroves, salt-water marshes, or oyster
bars. The dock decking design and construction should ensure maximum light
penetration.
____ Adequate water depth exists in the proposed vessel mooring area so
that a minimum of one foot clearance is provided between the deepest draft
of the vessel and the top of any submerged resources at MLW or OLW.
____ The dock access walkway is no more than 4' wide.
____ The terminal platform (the part of the dock that a boat can moor
along) is no more than 160 sq. ft.
____ If the terminal platform terminates over seagrasses, corals,
mangroves, salt-water marshes, or oyster bars, 75% of the surface area of
the platform is elevated to a minimum height of 5' above MHW or OHW and
25% of the surface area of the platform is at a lower elevation to
facilitate access between the platform and waters of the preserve or a
vessel.
____ The dock accommodates the mooring of no more than two vessels.
____ No roofs proposed over boat slips.
____ No non-water dependent structures are proposed (i.e. tiki-huts,
sun decks, etc.)
