RE: Memo from Secretary Hood to Florida's Supervisors of Elections regarding new filing deadlines under the Election Emergency Contingency Plan for Counties Affected by Hurricane Charlie

Please find attached a copy of the memo the Secretary of State Glenda Hood signed today as well as the electronic copy of the deadline waiver schedule.

Pursuant to Executive Order 04-182, Governor Jeb Bush declared an "elections emergency" in Charlotte, DeSoto, Hardee, Highlands, Lee, Orange, Osceola, Seminole, Volusia and Polk Counties as a result of Hurricane Charley. Pursuant to this authority, Governor Bush in his letter dated August 19, 2004, vested in my office the authority to modify, amend or suspend elections' deadlines in these counties.

Accordingly, I am extending the deadline for the filing of the 2004 F2 Campaign Treasurer's Report from August 13, 2004 to August 27, 2004 for any candidate, political committee, committee of continuous existence, electioneering communications organization or individual, or an individual or person making an independent expenditure, which must be reported, who is in a county which is an "elections emergency" county.

To be in a county which is an "elections emergency" county, the candidate, treasurer, deputy treasurer, chairman or other person who is responsible under Chapter 106, Florida Statutes, for the filing of the Campaign Treasurer's Report must reside in an "elections emergency" county. There may be other candidates, political committees, committees of continuous existence, electioneering communications organizations or individuals, or individuals or persons making independent expenditures, which must be reported, who were affected by Hurricane Charley and whose Campaign Treasurer's Reports were late. However, fines for the late filing of these reports must be appealed to the Florida Elections Commission.

Please note that August 27, 2004 is also the deadline for filing the F3 report. Two separate reports need to be filed for the two reporting periods. Do not combine the two reports into one report.

Additionally, I am also extending the deadlines in the declared "elections emergency" counties for the submission of poll watchers designations to Wednesday, August 25, 2004 at 5 p.m. and the deadline for approval of such designations by the Supervisor of Elections to Friday, August 27, 2004 at 5 p.m. Attached, and incorporated by reference, is a chart which outlines all potentially impacted statutory deadlines for the upcoming August 31, 2004 Primary Elections and specifically denotes which deadlines are and are not waived or amended.
