This subject property is vacant land located in Seminole County and consists of approximately 3.51 +/- acres. It is an irregular shape and was formerly used as a railroad right-of-way. The property is located approximately 1,450 feet east of and parallel to Geneva Drive, extending northeast of East Franklin Street and southwest of East Broadway Street to the east side of Oviedo Boulevard, within the municipal limits of Oviedo, Florida. The property will be conveyed with a deed restriction encompassing approximately 1.72 acres of the property. The restriction will prevent the construction of structures, dumping, removal of trees, etc. and takes on the same use as wetlands/recreational land. County Tax ID: 10-21-31-300-095A-0000 and a portion of 15-21-31-300-0840-0000.

The property is to be sold via sealed bid "as is", "where is". Bids will be accepted until 10:00a.m. EST, January 23, 2013. Any bid received after that time will be retruned to the BIDDER unopened. The Department of Environmental Protection is not responsible for bids mailed but not received by 10:00a.m. EST, January 23, 2013. All bids received by the bid submission deadline will be publicly opened at 11:00a.m. EST, January 23, 2013.

The minimum acceptable bid will be $135,000.00. Any bids that are less than minimum acceptable bid will be considered counterproposals and will be deemed non-responsive and rejected.

BIDDERS are cautioned to carefully examine this bid invitation, the property being offered for sale and to be thoroughly informed regarding any and all conditions and requirements of this bid invitation. A BIDDER will not be relieved of any liabilities and/or obligations resulting from lack of knowledge of conditions or requirements.

Access: LESSEE acknowledges that the Property is landlocked and has no legal access. In the event LESSEE is denied physical access to the leased premises by others such that LESSEE can no longer use or occupy the leased premises, LESSOR may at its own cost and expense, and without the duty or obligation, take the necessary action to secure an access easement to and from the leased premises. In such event, LESSEE shall have the option of 1) remaining in possession of the leased premises and cooperating with LESSOR’s efforts to obtain legal access to the leased premises. Annual rental payments shall abate during the lease term as long as physical access to the leased premises is denied to the LESSEE, or 2) terminate this lease and vacate the leased premises forthwith thereafter.

The "Bid Form" and the "Contract for Sale and Purchase and Deposit Receipt" shall be completed in their entirely and be submitted in accordance with the procedures set forth in this bid invitation. Otherwise, the bid will be rejected. The offer for the property shall be entered on the Bid Form and on paragraph 2 of the Contract for Sale and Purchase and Deposit Receipt. Complete the blanks only. Any changes to the contract whether additions or deletions will cause the contract to become ineligible for consideration. NO OTHER TYPE OF "BID FORM" OR "PROPOSAL SHEET" WILL BE ACCEPTED AS A VALID RESPONSE TO THIS BID INVITATION.

Any award made will be to the highest responsive BIDDER, provided it is in the TRUSTEES' interest to accept the bid. The TRUSTEES or the DEPARTMENT, as staff to the TRUSTEES, reserve the right to reject any or all bids. The TRUSTEES or the DEPARTMENT further reserve the right to waive any minor irregularities in any bid received.
